YOUR LEGAL RIGHTS AS A CONSUMER IN THE UK
At law, you also have certain rights that protect you if that the Product that you have purchased is faulty. This means that your legal rights will apply (in addition to this limited manufacturer’s warranty) when the Product, or a material component provided in a Product is non-conforming, either because:
a) it does not match the description;
b) it is not of satisfactory quality; or
c) it is not fit for purpose.
The limited warranty we are providing above is a manufacturer’s warranty and applies in addition to, and does not affect, the legal rights that you have against a retailer should the Product not conform or be defective. That includes the mandatory legal warranty that the retailer must provide to you.
These legal rights only apply to Products that you have bought acting as a consumer. This means you cannot exercise these rights for goods that you purchased in the course of business, or for professional use.
Your consumer rights are valid against the retailer who sold you the Product in question, even if that retailer is different to us as the manufacturer of the goods. If the Product is faulty, you are entitled to claim a repair or replacement of the Product from the retailer under that mandatory legal warranty. Alternatively, if you have not used the Product, and it was faulty when it was delivered, you may be entitled to a full refund. Please note that your entitlement to a refund under the legal warranty will depend on:
a) firstly, whether the defect was apparent on delivery, or whether this became apparent at a later date; and
b) secondly, whether and to what extent you have made use of the Product.
If you have used the Product for more than six (6) months, then before a repair or replacement is offered, you may be asked by the retailer to provide evidence that the Product was faulty when delivered.
In some cases, repair or replacement is not possible, or would be disproportionately costly given the value of the Product and the nature of the fault. In these instances, you may be entitled to either keep the Product and claim a reduction in price, or it may be possible to return the Product and obtain a partial refund. In determining the price reduction or the level of the refund, the retailer may take into account the time that has passed since they delivered the Product and the use you have made of the Product since it was delivered to you. If you have had the Product for more than six (6) months, then before a reduction in price or partial refund is offered the retailer may ask you for evidence that the Product was faulty when delivered.

EVANS Hybrid Sensory Percussion - France
The EVANS Hybrid Sensory Percussion powered by Sunhouse
Contrat de Garantie Commerciale
TERMS AND CONDITIONS
(Effective as of July 3, 2023)
Before using the EVANS Hybrid Sensory Percussion Sound System (the “Product(s)”), please read through these Commercial Warranty Agreement (“Commercial Warranty”).
D'Addario & Company, Inc., a company incorporated in the State of New York, United States of America, whose registered office address is at 595 Smith Street, Farmingdale, New York, 11735 ("D'Addario") warrants the Product, purchased from an authorized D'Addario reseller in France, against manufacturer defects in material or workmanship when accompanied by a dated sales receipt (sales receipt in electronic mail form is satisfactory). This Commercial Warranty is free of charge and applies to the original owner of the Product, and is void if the Product is sold or transferred.
If you are a consumer, the rights provided to you under this Commercial Warranty are provided alongside and in addition to all rights and remedies granted to you by consumer protection laws and regulations and do not affect the legal rights you have which are applicable to consumers in France. These statutory rights can be exercised at no additional cost.
In particular, your statutory rights are as follows:
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d'enlèvement du bien non conforme, ou s'il supporte les frais d'installation du bien réparé ou de remplacement ;
Note that in the box above, “professional” means the “seller” from whom you bought the Product(s), except in the case of the mandatory legal warranty against latent defect set forth by articles 1641 to 1649 to which both the seller and manufacturer (D’Addario) are subject.
Should the Product be defective, or if it does not conform the conditions of use, you can choose to make a claim under your statutory rights set forth by French law described in the box above or this Commercial Warranty.
